These Regulations relate to the NHASA Halal Product Certification Mark as shown in Fig. 1 below owned by Muslims Australia / Australian Federation of Islamic Councils and licensed to the Certification Body for the purposes detailed below.
NHASA Halal Certification reserves the right to replace the Certification Mark by another Mark at any time.
Use of the Certification Mark for a renewable three-year period is strictly limited to the Client whose products and/or processes has been successfully certified by the Certification Body.
Issuing a Certificate grants the client a limited, non-exclusive and non-transferrable license to use the Product Certification Mark. The Product Certification Marks tell your potential customers and stakeholders that you have the capability to produce a product that consistently meets a specific standard.
For maximum benefit, the Product Certification Mark should be displayed on the product itself.
In cases where labels are not applied, licensees may apply the Certification Mark to the product in a manner that suits their production process (e.g. manually stamping production cartons) and the method and process must be agreed with NHASA Halal Certification.
Product Certification Marks must be accompanied by the identification of the publisher and number of the standard or specification to which the product has been certified. This information means that the consumer can, if they wish, check the content of the standard to ensure that the certification covers the important product attributes from their point of view. Also, because it is the manufacturer of the product who is the licensee, the Mark and Licence number should be displayed in proximity to the manufacturer’s name.
The remuneration for the use of the Certification Mark is included in the agreed contract amount and no further license fees are payable for the use of the Product Certification Mark.
The Client agrees that:
Product Certification applies to specific products or product ranges or models. If you are using the License Halal Certification Mark in Australia in advertising, make sure that you have clearly indicated which products are certified.
Use of the Product Certification Marks in a general advertisement or in a product catalogue can sometimes wrongly imply that all products in a range are certified. When more than one product is being advertised, the Product Conformance Mark may only be used in association with the specific products covered by your Certification Licence.
Use of the Certification Mark does not exonerate the Client from any liability imposed by law regarding the performance of its services and the performance, design, manufacturing, shipment, sale or distribution of its products.
In case of improper use of the Certification mark, NHASA Halal Certification may suspend or withdraw the certification and the right to use the Certification Mark by the requirements of the applicable certification scheme or breaches of the contract.
The Client may appeal NHASA Halal Certification’s decision in accordance with the Appeals & Issues Procedure that will be provided by the Certification Body upon request.
The Certification Body reserves the right to modify these Regulations at any time. It will give the Client written notification of all changes thereto and the Client will be obligated to apply said changes.
